A charitable remainder trust splits the interest of a trust between beneficiaries. The first interest of the trust is passed to a beneficiary for either 20 years or for the length of the beneficiary's life. Once the time has expired or the beneficiary dies, the remaining property passes to a charitable organization. However, in order to receive an income tax deduction for the amount of the trust that passes to the charity, the interest that passes to the charity must be at least 10% of the fair market value of the property that was originally placed into the trust.
